Welcome to WillowShoreBay ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at willowshorebay.sbs (the "Service") operated by WillowShoreBay.
By reserving a yacht or utilising our Service, you consent to these Terms. If you do not accept these terms in full, you are not permitted to use the Service.
2. Service Overview
WillowShoreBay offers a variety of luxury yacht chartering services, which include but are not limited to:
- Yacht hires for the day
- Evening yacht experiences
- Company getaways
- Exclusive gatherings
- Extended yacht journeys
Availability of services is contingent on various factors and we may change or cease services at any given time without notice.
3. Booking and Reservations
3.1 Booking Process
When making a reservation for a charter, you must:
- Have reached the age of 18 years
- Supply precise and up-to-date information
- Remit a deposit as per the details in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation occurs only after we receive your payment and send you a written confirmation. We maintain the discretion to deny service to any individual.
3.3 Availability
Charter availability hinges on the accessibility of the vessel and favorable weather. We will endeavor to meet your preferred scheduling.
4. Payment Terms
4.1 Pricing
Our prices are stated in € and include all relevant taxes unless specified otherwise. Price alterations can occur without prior notification.
4.2 Payment Schedule
- Deposit: A 50% payment of the overall cost of the charter, payable at the time of reservation
- Balance: Required to be settled 48 hours prior to the departure of the charter
- Supplementary charges, if applicable: Payable upon the culmination of the charter
4.3 Payment Methods
We accept various forms of payment such as major credit cards, direct bank transactions, and certified bank drafts. All payment processing is safeguarded with encrypted measures.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours before the departure time: entire amount refunded minus transaction fees
- If cancelled within 24 to 72 hours prior to departure: half of the payment is refundable
- If cancellation takes place less than 24 hours before the planned departure: non-refundable
5.2 Weather Cancellations
Should the weather be declared unfit for sailing by our captain, we will propose:
- The option to reschedule the charter to a new date with no additional cost
- A refund in full if rescheduling cannot be accommodated
5.3 Mechanical Issues
In the event that your designated vessel encounters mechanical issues, we will seek to offer a comparable substitute. If a substitute is unavailable, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
Passenger obligations include:
- Adhering to all instructions given by the crew
- Using the safety gear provided as needed
- Informing of any health conditions that might affect personal safety
- Staying within the permitted areas on the vessel
6.2 Prohibited Items
Items that are forbidden aboard include:
- Containers made of glass
- Unlawful materials
- Firearms or other weaponry
- Excessive quantities of drinks (beyond reasonable consumption)
- Pets (unless given prior permission)
6.3 Conduct
Passengers are expected to behave in a manner that is respectful. Should any passenger's behavior present a safety hazard or disrupt the experience for others, we reserve the right to terminate the charter prematurely without a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our financial responsibility to the fees paid for your charter. We are not accountable for:
- Injury to persons due to their own negligence
- Loss or damage of personal belongings
- Secondary, incidental or punitive damages
- Delays due to weather or situations beyond our control
7.2 Insurance Coverage
Our vessels and operations are protected with comprehensive marine insurance. Passengers must arrange their own travel and personal possessions insurance.
7.3 Assumption of Risk
Participating in our charter services signifies acknowledging the inherent dangers involved in marine activities, assuming all responsibility for your safety and actions.
8. Modifications and Itinerary Changes
We hold the right to alter travel itineraries, routes, or timetables due to weather conditions, safety reasons, or operational necessities. We will strive to offer equivalent alternatives whenever changes occur.
9. Force Majeure
We are not accountable for any hold-ups, cancellations, or service alterations caused by forces outside our control, including, but not confined to:
- Extreme weather scenarios
- Natural disasters
- Regulations imposed by the government
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
Your private data is managed in conformity with our Privacy Policy. By employing our services, you agree to the gathering and usage of your data as detailed in our Privacy Policy.
11. Intellectual Property
All materials on our website, including text, visual elements, trademarks, and photos are covered by copyright and trademark laws. Unauthorized replication, distribution, or derivative creation is prohibited without our explicit consent.
12. Governing Law
The applicable laws of Germany govern these Terms. Any disputes shall be adjudicated in the competent courts situated in Hamburg, Germany.
